We are in the process of re-launching the MyHouseKeys platform in 2021.  Our new website will include an online account for homeowners to create service tickets and track the progress of their refinance and resale transactions.  In the meantime, please start the process for any resale or refinance requests by clicking here to  Open a Service Ticket.  We have the following team members that will assist you.  They will collectively receive any messages you send to customerservice@housekeys.org.  Please note that all transactions are handled according to the Terms and Conditions contained in your Recorded Restriction Agreement.  Any remaining items should be addressed by the City Council Approved Program Guidelines.  It’s important to note that the city has had an affordable home ownership program in place for nearly 40 years. Our team has to keep in mind that EACH RESTRICTION AGREEMENT IS DIFFERENT and part of responding to any homeowner inquiry involves reviewing the terms and conditions and determining how the transaction (whether it be a refinance or resale) must be handled.

We will be updating this page with the processes involved with re-selling a below market rate / resale restricted home and getting a refinance completed with one of our Registered Loan Officers. See the Registered Lenders and Loan Officer List to see if you would like to process your refinance transaction.  If you have a lender that you’d like to work with who is not on the list, you can direct them to the Lender Page to get setup as an approved lender and have them register for a loan officer/lender orientation.

It is important to understand the steps involved.  In order to do so, we must receive your ticket and assess your recorded restriction agreement in order to determine how your refinance or resale transaction is to be processed.  Please note:  Opening a Service Ticket does not begin any of the official legal transaction timelines that are outlined in your recorded agreement.

MyHouseKeys is our web-based software platform created to help you manage your program relationships, find housing opportunities, and navigate the application process. You start by registering your household profile.

profile Registration Process

When you click on the button to “Register Your Profile, you’ll begin with a quick sign up form that asks: Name, Number of Household Members, Total Household Income, and Zip Code. After you enter and confirm your email address, you will start a Registration Wizard that will have you complete a series of forms. You may want to set aside an hour to complete all of the online forms. These forms include:

  1. Admin Profile - this is the basic information and address for the primary applicant.

  2. Member Profiles - all other household members who will be occupying the housing unit

  3. Income Profile - you’ll identify the type of income that you earn, information about your employer, and your employment details

  4. Household Preference - this form details any special criteria that your household may meet that would allow you to receive preferential treatment among other applicants.

  5. Household Demographics - this is an optional form that allows us to track our Fair Housing statistics

At the end of the process, you’ll get to a page called the Household Overview. This page summarizes all of the information you entered and gives you a chance to review before finalizing.

Resale Restriction Agreement

The City of Morgan Hill has a resale restriction agreement with terms (for many years) that restricts the price at which a home can be resold and carries other restrictions, including refinancing and inheritance. Please make sure to review the document that you signed when you purchased your home through the program.

Excess Sales Proceeds Note and Deed of Trust

The difference between the fair market value of the home and the maximum restricted resale price is known as “Excess Sales Proceeds”. This amount of money belongs to the program and the City records a note and deed of trust in order to protect those proceeds. Click the links below to open the examples. Program Guides

These program guides were created in the Fall of 2018 to provide Applicants and Participants with the rules and processes involved with the housing programs.

Participation Guide

Once you are a homeowner, you sign a 45-year Restriction Agreement that details what you are allowed to do with the home. While the Restriction Agreement on this site is the latest version, there have been many different versions used over the past 40 years. The Participation Guide walks through some of the rules on refinancing, re-selling the home, and transfers for inheritance. Please keep in mind that your signed Restriction Agreement is the governing document that ultimately determines what you’re allowed to do.

Kamala Loving, Program Operations Coordinator

Kamala is our lead contact to get processes started for applicants and participants.  She will help us log your ticket to officially enter it into our queue.  Please keep in mind that we must research the file and determine what your agreement says about what we’re allowed to do with regard to your refinance or resale transaction.  Your Restriction Agreement and the Council-Approved Program Guidelines determine how each transaction is handled. For refinance transactions, we will connect with one of our approved lenders so they can help put together a refinance package for review and approval.

Katarina Marusic, Program Transaction Coordinator

In the case of a sale transaction, Katarina coordinates with our real estate team to make sure that we are preparing you to enter the resale process. There are legal timelines that are outlined in your recorded agreement. If you can’t locate your agreement, please let us know immediately as the process cannot begin until this agreement is reviewed.

Christina Enriquez, Asset Manager

Christina is our Asset Manager who completes the review of the restriction agreement, and works with the escrow company to ensure that we are properly prepared for a refinance or resale transaction.
